Terms of Service

1. About SellShnell

SellShnell ("SellShnell", "we", "us") runs a website where people in the heimish community can list items for sale and find items to buy. By using the website, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you don't agree, please don't use SellShnell.

SellShnell is only a listing service. We do not own, sell, buy, inspect, store, ship or deliver any item. We do not handle payments, hold money, or guarantee any item, listing, buyer or seller. Every sale is a direct agreement between the buyer and the seller.

2. Who can use SellShnell

You must be at least 18 years old to post a listing or contact a seller. You agree to give true and accurate information, including your email address and phone number, and to keep it up to date.

3. Signing in

Sellers and admins sign in with a one-time code sent to their email. You are responsible for everything done with your email address on SellShnell. Don't share your codes. If you think someone else used your email to sign in, tell us right away through the Contact us form.

4. Listings

When you post a listing, you promise that:

• you own the item or have the right to sell it;
• the item is legal to sell where you and the buyer are;
• the description, photos, condition, quantity, price and location are true and not misleading, and the photos are of the actual item or you have the right to use them; and
• you will update the listing right away when an item sells or anything changes, by lowering the quantity, changing the price, or removing the listing.

New listings are reviewed before buyers can see them. We may approve, reject, edit, hide or remove any listing at any time, for any reason, with or without notice. After a listing has been live for 30 days, we email the seller to ask if it is still for sale. If the seller doesn't answer within 36 hours, the listing is removed automatically.

After you submit a listing, you can change only its price and quantity, or remove it. To change anything else, contact us.

5. Taxes and legal obligations are the seller's

Each seller is solely and fully responsible for all legal obligations connected to their listings and sales. This includes, without limit:

• collecting, reporting and paying any sales tax, use tax, income tax and any other tax or fee;
• any business license, permit or registration the seller needs;
• following all consumer-protection, product-safety and recall rules, including rules for children's products, car seats, cribs and other regulated items;
• any warranty, refund, return or disclosure the law requires; and
• keeping their own records.

SellShnell does not collect, report or pay taxes for anyone, and does not give tax, legal or financial advice. If you are not sure what applies to you, ask a qualified professional. Sellers must agree to this before posting a listing.

6. Sharing seller contact information

By posting a listing, you agree that your email address and phone number (and your name, if you give one) are shown to anyone who clicks "Show seller contact info" on your listing. Buyers may contact you by phone, text or email about your item. If you choose, we email you the first time a buyer opens your contact info for a listing.

Anyone who views a seller's contact information may use it only to ask about that item. You may not copy or collect contact information from SellShnell, or use it for advertising, solicitation, spam or any other purpose.

7. What you may not list or do

You may not list:

• anything illegal, stolen, counterfeit or recalled, or anything unsafe;
• weapons, ammunition, explosives or fireworks;
• drugs, drug paraphernalia, prescription medication, alcohol, tobacco, vaping products or cannabis;
• live animals other than fish and birds where selling them is legal;
• adult content, or items, images or words that don't fit the standards of our community; or
• services, jobs, rentals, real estate, or anything that isn't a physical item, unless we allow it.

You may not: post false or misleading listings; run scams or ask for payment by gift card, wire transfer or similar methods for an item you don't intend to deliver; harass, threaten or mislead anyone; post someone else's personal information; use bots, scrapers or automated tools on the website; interfere with how the website works; or try to get into parts of the website you aren't allowed to use.

We decide what fits SellShnell. We may remove content and block anyone who breaks these Terms.

8. Buying safely

SellShnell does not verify sellers, items or listings. Before you pay, see the item and check that it is what you expect. Meet in a safe, public place when you can. Never pay by gift card, wire transfer or cryptocurrency to someone you don't know. Every purchase is at your own risk and is between you and the seller.

9. Listings our team posts for you

If you ask our team to post a listing for you (for example, by phone), you are responsible for it as if you posted it yourself, and these Terms apply to you and to that listing. Check the listing, and tell us right away if anything in it is wrong. When you sign in with the same email, you can manage the listing yourself.

10. Your content

You keep ownership of the text and photos you post. You give SellShnell a free, worldwide, non-exclusive license to host, store, copy, resize, display and show your content on the website and in emails about it, for as long as it is on SellShnell and for a reasonable time after for our records. You confirm you have the rights needed to give us this license.

11. Advertisements

The website shows advertisements. Ads come from third parties, and showing an ad is not an endorsement. Anything you do with an advertiser is between you and them.

12. No warranties

SellShnell is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind, whether express or implied, including about any listing, item, buyer or seller, the accuracy of anything on the website, or that the website will always be available, secure or free of errors.

13. Limitation of liability

To the fullest extent the law allows, SellShnell and the people who run, build and work on it are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, profits, data or goodwill, arising from your use of SellShnell or from any item, listing, sale, meeting, message or dispute between users. Our total liability for any claim relating to SellShnell is limited to one hundred US dollars (US$100). Some places don't allow some of these limits, so they may not all apply to you.

14. Indemnification

You agree to defend, indemnify and hold harmless SellShnell and the people who run, build and work on it from any claim, loss, liability, tax, penalty, cost or expense (including reasonable legal fees) that comes from your listings, your sales or purchases, your content, your breaking these Terms, or your breaking any law or anyone else's rights.

15. Disputes between users

Any disagreement about an item or sale is between the buyer and the seller. We may try to help, but we don't have to. You release SellShnell from any claim connected to a dispute with another user.

16. Changes and ending your use

We may change these Terms at any time. We will post the new version on this page with a new effective date. If the change is important, we may ask sellers to agree again before posting. If you keep using SellShnell after a change, you accept the new Terms. We may change, pause or stop SellShnell, or stop anyone from using it, at any time.

17. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute with SellShnell will be handled only in the state or federal courts located in New York, and you agree to their jurisdiction.

18. General

If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a part of these Terms, we haven't given up the right to enforce it later. These Terms and the Privacy Policy are the whole agreement between you and SellShnell about the website.
